It is often said that the only winners in litigation, civil disputes and court cases are the lawyers.

Increasingly, individuals, businesses, companies and lawyers themselves are learning that there is a real alternative.

The Mediation Centre at Nowell Meller Solicitors has gained a national reputation for its effective and pioneering work in the area of family mediation.

We now also offer our own dedicated civil and commercial mediation service.

What is mediation?

Mediation is a process by which those involved in a claim, dispute or court case reach a solution by talking, listening and negotiating with the help of a neutral and independent professional mediator.

Why mediate?

In the vast majority of cases the courts now expect, and sometimes encourage lawyers to consider whether mediation should be used in their clients’ cases. It can avoid the very high cost that would otherwise be incurred and it avoids the stresses and uncertainty that taking any case to court inevitably involves. It allows people to take control of their dispute and can bring about a result in much less time.

What sorts of dispute are suitable?

Mediation can be used in a wide variety of disputes and some recent examples are bullying and harassment claims at work, boundary disputes, disputes with builders, disputes about Wills and professional negligence claims. Indeed, we at The Mediation Centre believe we can help, no matter what the type of civil or commercial problem you have.

How does it work?

In most cases the mediation will take place at our offices at St Mary’s Grove. There will be a mixture of joint and private sessions focused upon investigating and exploring the issues and enabling people to reach their own solution. Your own lawyer will generally come with you to help. Also, in most cases, the entire process is concluded in one day or less.

'I don't know how you did it !' A solicitor commenting after a recent Civil Mediation which invovled a long standing entrenched dispute between neighbours in which allegations and counter allegations of trespass, nuisance, harrassment and land encroachment had been going on for over 12 months.
