Mediation and the courts

Going to Court doesn’t mean that mediation is no longer appropriate. It may be more suitable than ever, even when it’s been tried before.

Mediation used to be seen as a process that took place entirely separate and before Court proceedings, away from the arena of litigation and in a vacuum.

We believe that mediation often produces the best results in entrenched, difficult and complex cases.

If you are a prospective client:
It may help you to look at other parts of this website to see the advantages and disadvantages of mediation – see in particular choosing the right process

If you have a professional interest:
We have been undertaking pioneering work to gain greater understanding between Judges, Court staff, family lawyers, CAFCASS and mediators, as to which process is best for families and children and when.

We have recently participated in FMA’s National Conference on Working in Partnership, Mediation Awareness Week, and some Judicial Awareness Training
Our most recent Guidance to Judges and to others is attached
