Civil & Commercial

Increasingly, individuals, businesses, companies and lawyers themselves are learning that there is a real alternative to the Court that is cheaper, quicker and can often preserve the business relationship for the future.

The Mediation Centre has already gained a national reputation for its effective and pioneering work in the area of family mediation.

We also offer our own dedicated civil and commercial mediation service.

Our main interest is in the resolution of conflicts in relationships. This means we have a particular expertise in resolving commercial or workplace disputes where communication is a central issue, and we have developed new models of working in cases such as cohabitation disputes or contested probates which straddle the family and civil jurisdictions. But we are equally willing to offer expert, bespoke mediation to any commercial or civil issue.

What is mediation?

Mediation is a process by which those involved in a claim, dispute or court case reach a solution by talking, listening and negotiating with the help of a neutral and independent professional mediator.

Why mediate?

The Courts now expect lawyers and clients to consider whether mediation should be used. It can avoid the very high cost that would otherwise be incurred and it avoids the stresses and uncertainty that taking any case to Court inevitably involves. It allows people to take control of their dispute and can bring about a result in much less time.

What sorts of dispute are suitable?

Mediation can be used in a wide variety of disputes and some recent examples are:

  • Bullying and harassment claims at work
  • Boundary disputes
  • Disputes with builders
  • Disputes about Wills
  • Professional negligence claims.

Indeed, we at The Mediation Centre believe we can help, no matter what the type of civil or commercial problem you have.

How does it work?

The mediation usually takes place where you or your lawyers are. There will be a mixture of joint and private sessions focused upon investigating and exploring the issues and enabling people to reach their own solution. Your own lawyer will generally come with you to help. Also, in most cases, the entire process is concluded in one day or less.

Enhanced or Mixed Mediation Models

At The Mediation Centre we are pioneers in the use of processes and strategies drawn from both civil and family models to make sure we can provide a unique forum for the settlement of your financial and relationship difficulties. These models are especially valuable in relationship disputes which find themselves in the very costly civil jurisdiction, such as Inheritance Act claims and disputes over property following cohabitation. Visit our Information Bank for more details of these services.
